Rupert neve nicked my photo !

is nothing safe anymore :(
hidden in our website is a photo of the first neve console which i owned for a while years ago

it seems rupert and co nicked the photo of the console sitting in my lounge room for their website promo

should i sue him ..?
or maybe just get them to send me some of his old stuff for free :)

i would pirsue that, either for $$ or free neve gear...

it would be funny if you sued them though, getting sued for a pic of their own gear, haha , this i'd like to see


i say go for it, pursue it, just for the sake of what might turn out to be, id really love to see the results.

Well i wouldn't be too quick off the mark to try and sue......... all too American for my liking.
An email from your solicitor explaining the pic is yours and it would have been decent of them to contact you first to work out some arrangement for it's use. For all we know that pick may have been "found" on some other collection of neve gear pics as it is probablyall over the place by now because it's been up for a few years now. Since putting a few pics of my optro gear on the web i have seen them pop up in a few other places as vintage gear pics do the rounds.

jeez i am not going to sue Rupert Neve !
i am just bemoaning my lot in life lately is getting this website photos nicked every time somebody
doesnt want to do any work


however the pic is mine no matter how many people have already nicked it

fair use and all that - but its not really fair use on that site its a commerce thing for them
or it wouldnt be there

lets see what they say , i bet its "oh my webguy found it on a free internet image site etc etc "
i wonder if they could imagine what i would have given them if they actually asked first !

why do you think they didnt use the one with my cute little animals in it ..?

I agree with Chris H.

This is archival stuff and the least Rupert could do is credit you as the photographer.

they didnt even credit me and they are my good friends ..!

i gave up worrying about credits of any kind a long long time ago ,
but i do like to be asked ...
do one to others and all that stuff

if it was on a slutty forum yeah yeah sure .... fair use .. public interest etc etc
but ...
well you know the but

whos taking bets on wether i get any response from them ..?

No worries Rick. I didn't think you were seriously thinking of filing a law suit. Rupert probably hasn't got any old neve gear anyway. You might get a few portico modules if you are lucky.

While we are at it, I have an interesting neve story. About 8 years ago i was getting some video's edited and duplicated by an elderly British gentleman who had been in the game since the early 50's and he was telling me some of his stories doing OB recording in England from a truck he had set up. As i showed a bit of interest he got his photo album out and there standing next to him in his van, in a pic of a console he had custom made was who i thought to be Mr Neve himself. When i casually asked him about the desk he told me it was made for him by his mate Rupert. As if it was of no consequence at all he continued with descriptions of what it was like to work in the field in those times.

This has nothing to do with ownership however, I would assume that if you put a picture on the internet, it would only require one person to copy it, there is no way it can ever be removed, it will be there for eternity.

Rick as you have such crap luck with your pics on the internet, perhaps you should just give verbal descriptions of your pics etc on your website from now on.

Also it is a good thing that Rupert didn't use the picture with the cat and dog in it, then they could potentially have 3 suits on their hands, one from the cat, one from the dog and one from Rick. I guess the resulting compensation would be, Wiskas, Pal, some squeaky toys and modules, the squeaky toys would be for your dog and cat of course........unless you wanted some squeaky toys too..........hmmmm!!

He'll get real pissed of when us stooges buy them for $300 each. we've suddenly devalued his legacy.

I can't believe you're seriously getting upset over that - the previous stolen pics were clearly a problem but this?? A piece of equipment he made......wow.

I dunno.... at first glance it's pretty minor - BUT it's just another example of how on the web nobody's work is worth anything.

what about the run of new rupert neve brochures using my photo in there timeline to prove the point that rupert built class A tube consoles in the 1960s and the new console has come full circle to here he started ..?
its amazing that those two are the only photos he could get
i would have thought if he just asked it would be no problem from anybody .
but then there were only two ever built and apparently only one left


i am more annoyed that the general idea is you dont ask for this stuff anymore
i understand fair is fair out in the big world
and btw
the desk delivery letter on my site is mine as well not a photo of somebody else stuff
as well as the schematics and a bunch of stuff that i didnt post

the photo hidden away on my site was put there as a surprise to my clients for bothering to spend time reading our blag
not as marketing advantage for ruperts clients or as free artwork to promote his new company
you will notice a distinct lack of photos that NEVE /AMS own used in his promo

i wonder why ? well the answer is obvious they WOULD sue him !

i am just making them aware - not bets on the out come ..?

Just a question.. do you know for sure he sourced it from your website? It's possible they got it from someone else who got it from someone else etc.

It's like Steven Spielberg using a shot of my edit suite.... I'd be stoked personally.

I think a nice phone call to Rupert to see if he would like some better pics? Maybe the perfect opprtunity to discuss becoming a beta tester for his up and coming products, obviously with a NO returns clause written in there of course ;)

I definitely see the point though, i think that Rupert needs to know where the photo originated from, and considering your the owner of such a prestigeous gem you never know, a lovely friendship may blossom or Rupert may offer you squillions to get it back!

Watermarks. It's always good to ask, I'm almost 100% certain that if they asked they probably would have received.

Maybe put a disclaimer in big red writing saying "I'm not a stingey bastard, ask if you want copies photos".
