stolen web studio again

jeez whats a guy got to do ?

this website has been up for about year, i tracked the guy down and rang him , apparently the actual working studio wont be up and running fully untill the end of the year !

so i tell him who i am ( the owner of the studio he ripped) and he tells me its all a simple misunderstanding , that he likes my studio so much when he gets funding ( which is why he has the website up ) he is going to build it just like mine !

i ask him to remove it today , he says he cant because he doesnt have the software to do it and because its part of an ongoing funding program he is working on .

i again ask him to remove it ..today
and i tell him it will take him one phone call to his isp. and i mentioned the word fraud

what gives ...? am i just part of the wrong team ..... this guy is fifty !

Hi Rick,

I read in AT when you described this in occurring before, and it must be very frustrating to have it happen again.

Have you done the "you will hear from my lawyer" thing yet?

How did you find this web site?

Just sent them an email asking them if they were nuts.
Didn't they hear about the last US company that did this?
I think the 14,000 readers of the AT mag would have already known that you dont ever want to mess with Mr Rick.
This will end up being extremely bad publicity for black rhino studios.

Aside from the obvious issues... who actually owns the copyright to that image? It's not cheap to pay what they fine you for breaching image copyright these days.

another studio owner sent it to me , the guy that runs this site is sure its all a misunderstanding
(and that its not supposed to be viewable on the web ? )
"but its been up for about a year
and he looked into taking it down last week , but err he cant !"

its a local oz studio (QLD) , and if it is a mistake....? it will come down today and nobody gets to go to court .

this guy kinda thought i was being a bit rude ...
after all (once he found out who was calling ) its all a misunderstanding !

thats it... my next studio will be in or at least look like a public toilet

It looks to have been changed. You must have scared him Rick, because in his links page the Turtlerock one goes to some software company..

yeah dave we have been through this the last time
my photographer dave anderson owns the image he can sue with a big stick if they don't remove it
maybe i can make some money then ...?

i believe in communication , not litigation

this guy actually thinks this is all ok ?
amazing .

and yes if you in the christian community ( which i am not.... but they strongly are )
you should be as outraged as i am that this site has somehow "slipped onto the web"

i live and wonder

Perhaps it was an act of Dog?
In the true spirit of 'do unto others' I have now put Sarah and Michelle on my website stating that I in fact produced them...

The studio name sounds sort of familliar also. INXS didn't record there did they.

I emailed and offered my services as a photographer if they're after some studio shots... somehow I don't think they can afford me.

You're thinking of Rhinoceros Studios, which was owned by INXS. Long gone now. I think the last album recorded there was 1927's last album, produced by Mark Opitz and engineered by Niven Garland. I think the SSL from Rhino ended up in Mixmasters' studio and I think Rhino is now Q Studios, part of the AIM.

There's a link to Turtle Rock (with the space) but it doesn't go to Rick's site.

I have a friend who knows a friend who knows a couple of guys on the "crew" list.... when I mentioned the whole thing he simply said "it sounds about right..." whatever that means.

This was his repsonse after emailing him:
"Hi Dale,
Thanks for letting me know.
This was a mock up website for a university assignment and was supposed to come down off the net once it was marked. It hasn’t been publicised anywhere. No ill feeling was intended, so I apologise if anyone has been upset by this.
We will be building a studio in the next couple of years and will have a professional website with photos of our studio once it is built
Rick from Turtle Rock has called me and his photo has been removed and the website will be disabled soon.
Again, sorry if any ill feeling was caused.
Have a great day
Regards,
Paul"

yeah , its all a misunderstanding... until you jump in my time machine and call him up and make enquiries about the studio last week .

the message is very different this afternoon then this morning . tommorrow it will be "all fixed up ' and by next week it is ancient history
sometimes i F@#$ing hate the way the internet rewites history .

look long and hard at the site , or project idea or whatever it is and remember these guys thought this was a non issue until i called them .

"keeping my kids away from this kind of misunderstanding " is this weeks goal

damn turkeys !

Told you that you need an uglier room. Bet the guy must feel like a right dick, how can you expect to get away with it?

If it truly is a uni assignment then the guy needs to be failed for plagiarism - its taken very seriously nowadays. First time catch you get 0 for the assignment, second catch you get 0 for the entire course. Serial offenders are expelled.

Its the problem that Gen XY has the impression that everything on the net is public domain and can be ripped.

see rick, your fundamental mistake in those studio photos, is the lack of massive seciruty guards, dobermans, and guns...no one would wana plagiarise a psychos website!

then again....some of the population is proving more and more than stupidity is replacing common sense, and common sense is almost a virtue...not very common...

Yeah, that depends what school you're at, and whether it's a university or not. You'd hope it would be taken seriously, my experience differs.

xy...? err
This guy is in his fifties !
with photos of his family and strong christian org links throughout the site

He has now taken my stuff down and apologized in the weirdest way , leaving us to feel that he still thinks he has done nothing wrong.

If this site started as a uni assignment which I accept it did and it was all a mistake sure , he should not have nicked the photo for that purpose (thats illegal), but it wouldn't have got me gunning at them I mean how would I have found out ...?.

However if you create an active fraudulent website and then leave it running for a year ( because its somehow not your job to take it down)?
there is only one reason you would leave it up
and that is because it served your purposes to leave it up , for whatever reason , maybe the funding he spoke of maybe as a "doorway"into his world" who knows who cares !
he cannot do it public-ally and legally with my studio photoshopped to look like his - simple fact

there no amount of tap dancing around this there really this WAS no mistake
if i had not i forced the issue this site would have run into the future
there was no shown intent here to remove it he admitted that other people had told him it was up and running as late as last week !

have a look at the "scholarship" program these guys have invented if you can be bothered

Better sign your kids up now :)
