Hey Guys - Quick Question,

I need to obtain some sort of release form that essentially states the following:

I (insert client name here) state that I have obtained the all necessary clearances / and licenses for worldwide distribution, for (name of track), published by (name of publisher), for use in video work (name of video here).

etc etc.


Basically, I have a client who insists that he/she has licensed a fairly well known commercial track for use in a video that I am producing.

I'm fairly sure that this isn't the case, and I'm hoping that by signing something official, the client may reconsider.

Any thoughts?

I'm trying to avoid going to a lawyer, as it's an expense that will not be recoupable.

completely going off my (often bad) memory here, but i think what you're after is a "Producer Liability Waiver"

which basically gets you off the hook and places any liability on ur client, if she's done the wrong thing. if you search for a template contract with that name, u might be in luck.

In this case I think you might want to ask the client to show you the paperwork regarding the licensing... I'd certainly feel entitled to sight the document/s if I was in your position. Unfortunately, getting them to sign a waiver is not always enough if it goes pear shaped - anyone involved can get sued, and I would expect the first person to get served would be The Producer.

But as you say, hopefully just showing them the form will put enough fear into them - you want to word it in such a way that there is no doubt they are on their own if they do the wrong thing, even if it might not stand up in court.

Oh, and probably especially important to go with your instincts now that you have expressed your doubts on a public forum ;-)
