I'm pretty sure there is no GST on second hand goods unless you buy them as part of your business of trading in such goods. See https://www.ato.gov.au/law/view/documen ... 2F00001%22

Hey, Simon replying to this. My business is GST registered. The business owns the system. I was unable to make sense of that document, however, my book keeper has always recorded sales of retired gear as including GST. If this is incorrect, I've got some GST to get back!

To any buyer - I'll investigate the GST further, however, my feeling is that is does attract GST, as I'm GST registered.

GST Registration for your business simply means you must account for GST transactions, it does not mean all of your transactions attract GST. But yes, get someone who knows to check it out for you.

And none of this should be read as criticism - it is not your fault Australia's tax laws are so complicated and hard for a small business to understand.

Good luck with the sale (GST inc or not!)

Chrisp - businesses must always include GST in the sale of capital assets, including to a private seller. (A "capital asset" includes any equipment purchased and retained for the purpose of earning an income, so it includes all gear, office equipment, etc.)

https://www.ato.gov.au/Business/GST/In- ... al-assets/

Your link above deals with the reverse case - a business buying a second hand asset from a non-registered seller.

Great - so I am (no longer) GST registered, and when I buy something from someone like me on this forum, it is GST exempt, but buying exactly the same gear from some poor business person on the forum it attracts GST and is 10% more expensive?

Its like the Government's bottled water rort. A bottle of water takeaway from Maccas is GST free, while eat in it gets 10% slapped on. Bring on tax reform.

Raises another issue - at the risk of adding another Forum on TurtleRock, it might be useful to have a place to have these sort of Running a Business type discussions could take place. Rick, its your sandbox, a Business Wisdom forum?
