Band Names

Postby jkhuri44 » Mon Sep 03, 2007 12:35 am

ok, ....im getting really pissed off right now!!

my band and i are trying to name ourselves, we go onto myspace, and every man and his bloody dog has this really cool
band name that we want....but you go to google, to try to find info on a band, and there's only 3 bands with the same name that are actualy marketing themselves for real...

does anyone know what the deal is with naming a band??

would you all say it would be ridiculous to name our band something that 3 other bands already have, and 90 others on myspace also have??

the question seems kind of obvious......

but i'll leave it for you guys to answer...

Name it after a horrible disease, it worked for Anthrax. Was listening to them today, just a thought. Heh.

Your band name is intellectual property - its a brand, and you'll need to own and control that property if you want to make any money out of merchandising and/or stop ripoffs.

So the answer to your question is not to search myspace, but to search the Australian trademarks register.
http://pericles.ipaustralia.gov.au/atmoss/falcon.application_start
and "enter as a guest".

Also do a business name search
http://www.abr.business.gov.au/

and web domain search.

Get all that in place and you will own the name for practical commercial purposes.

awesome, thanks for that chris!

i didnt think about it in "business" terms, but when you do, it makes alot more sense, and seperates the men from the kids :P

ok... start thinking about it in business terms... really. This isn't show friends, it's show business. Get yourselves a general partnership agreement now and define who gets what so if anything ever blows up and you get famous everyone knows what the deal is. So many people get screwed because they start out in a band with mates.

The "Mad Cows" would be a great name a girl punk band, though more than likely already used.
