Legal jargon on contract ?

Postby NYMo » Wed Apr 28, 2010 11:38 am

Hi there,

Long story short...

I have a 16 yo girl coming to the studio whose brother has a worldwide profile
(not in the music industry) and he has used some of his european contacts to *get her discovered* !

I usually have a standard contract I do with my clients and that usually works ok.

I'm sure I can do a good job of getting the music happening, but her voice is shall we say
*not ready for primetime*.

If she possibly meets disaster in Europe, how can I cover myself legally if the family turns around and blames me for her
failings ??.

All care taken no responsibility type of thing.

The family has money and power and I'm just trying to cover my ass in the eventuality something
*doesn't work out right* for her. They have even pulled her out of school to concentrate fulltime on her
*singing career* !

Any advice greatfully appreciated.

Cheers

Just put a clause in where once they approve the masters (by signing paper) your role is fulfilled and all responsibility post approval ( ie marketing, duplication etc) is theirs.
Preferably have a legal dude or dudess write it up.
The thing is, regardless of what you have on paper, if it doesn't work out they are going to look for someone other than their 'little star' to blame. As the old game show said ...
"It could be you!". I would dilute this potential by getting others involved downstream (mastering, maybe even get someone else to mix it) but just make sure they are on your team.
I wish you smooth sailing.

How many tracks are you doing? After doing 1 or 2 I'm sure you'll have an idea of how what you'll be in for.

Has'nt Rick got liquid nitrogen for special turd polishing? Ooooops! :)

John

Sounds like you don't need legal jargon, what you need is insurance! The good news is that the cost can be passed on to this client.

hey nymo
it doesnt matter a bit in her singing career if she cannot sing .. it never has !

can she entertain...?
that is the money making or breaking question

me thinks your worrying about the wrong end of the snake .

you wont get sued if everything else except her sounds great so whats the problem

and if in fact everything sounds great then your a "hitmaker "

so just get in there in the ring and start hitting or step out of the ring and stop worrying

i cannot see a contract worth a dollar that would cover you

Hi there,

Rick...you're right...I'm most probably being a bit over cautious.

I meet her tomorrow.. i don't even know what she's like.
Her voice coach is a friend of mine.

I'll keep you all posted as to how it goes.

Cheers
